In the wake of the government's crackdown on worksite enforcement, companies are looking to technology to be proactive in showing their compliance of employing a lawful workforce. Now technology has been developed for the I-9 process in an electronic form of storage as a way of helping some companies keep track of the I-9 form. The I-9 is the form required for employers to document both identity and work authorization since 1986 under the Immigration Reform and Control Act (IRCA).
The use of an internal I-9 auditing program can support a good faith defense against sanctions unless the government can show an employer had knowledge of an employee's unauthorized status. When used as one method to develop a company's immigration compliance program, the electronic form I-9 process can be a key system to reduce costs, improve efficiency and show good faith efforts to employ a legal workforce. More companies are turning to an electronic form I-9 process, including retention and electronic signatures
Our culture at Fisher & Phillips LLP fosters a collegial atmosphere that seamlessly integrates over 240 attorneys in 24 offices. As one of the largest labor and employment law boutiques in the country, we are constantly providing our attorneys with challenging, sophisticated and meaningful work. Despite our substantial growth in recent years, we continue to adhere to the same "small firm" sensibility that guided us in our formative years, including a steadfast devotion to the principle that every member of our team can make a lasting contribution, and that one's professional development should span an entire career.
While we believe in hard work, we also offer a balanced working environment that encourages all attorneys to become active within their communities. Moreover, we offer a culture that provides for a high degree of stability in an increasingly volatile legal market. Periodic job movement has unfortunately become common in our profession, but we are proud that our track record of low turnover runs counter to national trends.

Financial assistance
Currently, companies that fund the acquisitions of their own shares or fund an employee benefit trust for the purposes of assisting employees to acquire existing shares often have to consider whether that financial assistance is lawful. Generally financial assistance in this way in connection with a genuine employee share plan is permissible, but companies often need to consider carefully whether their particular share plan falls within the exemption under company law. Shares or options awarded to, for example, non-executive directors would not be caught under the exemption. From October 2008 (please note this could be extended to October 2009), private companies will no longer need to consider financial assistance issues (including whether the employee share scheme exemption could apply). The financial assistance provisions will continue to apply for public companies, although they will still be able to use the employee share scheme exemption provided the assistance does not reduce the net assets of the company, or to the extent it does, it is given out of distributable profits.
