Have we ever thought why our mobile phones are of rectangular in shape ?. Have we ever thought why this kit-kat is of three dimensional shape . can we imagine a reputed company file a lawsuit for making a product of the same shape may br your answer is no may be yes .

but this really happened in the very first week of new year . This happened in the chocolate world . Two powerful companies in the chocolate world nestle and Cadbury thrashing each other in the court

Nestle has won a trademark lawsuit against Cadbury over their rights to Kit Kat chocolate bar’s four-fingered and three-dimensional shape. After this other confectioners will not be able to sell products with a similar, four-bar structure anywhere in the European union.

Kit Kat's shape was registered by Nestlé in 2006. Cadbury applied to nullify the registration shortly thereafter, claiming that a trait as general as a product's shape could not be trademarked.

In addition to Cadbury's famous Creme Eggs,the company sells kit-kat –like product such as crispello , a chocolate bar with a "creamy center, wrapped in a delicate crispy shell, covered with a delicious layer of Cadbury chocolate."



Nestlé and Cadbury have a history of trademark struggle ,the most recent of which involved cadbury’s purple packaging When Cadbury won the right to the exclusive use of its own shade of purple (at least for candy), some questioned the wisdom of granting a trademark for an entire color.
