REGISTRATION

Registration is the process of obtaining certificate of registration (“RC”) from the authorities under the Act. A dealer registered under the act is called “Registered Dealer” (“RD”)


Any dealer, who intends to carry on the business of purchase and sale of goods in his state and is liable to pay tax, cannot carry on the business, unless he is registered and holds a valid RC under the Act.


Effects of registration:


After the registration, the dealer is liable to pay tax, if any, under the act, and also required to comply with other requirements of the act, till the registration is cancelled.


Procedure for obtaining registration:


To obtain registration, a dealer has to make an application in the prescribed form, along with required fees information, documents, etc.


After scrutiny of the application, the registration authority may:


• If it is complete in all respects, grant the registration and issue RC: or


• If it is incomplete with the requirements, after giving opportunity to the dealer or applicant, reject application after recording the reasons in writing.



CANCELLATION OF RC

The circumstances could be:

• Discontinuance of business; or

• Disposal of business; or

• Transfer of business to new location; or

• Turnover is lower than the specified limit, etc.



Procedure for cancellation


For cancellation the dealer should make the application as required. Thereupon the commissioner may cancel the registration.


For cancellation the dealer should return the RC.


Effect of cancellation


Upon cancellation the liability of the dealer ceases. However the cancellation shall not affect any outstanding liability or dues of the dealer on the day of cancellation.
