Jethmalani : Devil's Advocate

hmmmm...technically Jethmalani is right..He is following the Gita's msg given to Arjun by Lord Krishna.."oh! parth..just keep on doing ur karma without keeping expectations of the results"...Jethmalani is a lawyer..Every lawyer has his duty to "save" his client..This is the basic reason a lawyer has been hired for..THis is the fundamental work of a lawyer..this is his work ethics...Moreover every individual has another fundamental right which mite be stated in the Constitution or not but it is widely true and axiomatic in nature..that right is to "make money"..

Lets compare this case to a another hypothetical case of a dacoit/criminal/even a politician(just kidding:big_grin: ).approaches a doctor for help in dire state..he will die if the doctor does not help him,shall the doctor save him or let him die?a moral dilemma for the doctor..
Well to state it in crisp clear words,the duty of the doctor is to provide medical assistance to an individual to the best possible extent irrespective of the profession,gender,wealth,etc..etc..more adjectives,of the individual...Going by such definition,MAnu sharma has every right to seek a lawyer and a lawyer has every right to fight Manu's case...It is just like if one has the purchasing power,one can go on buying the best possible product..the product may be a shampoo or a lawyer..Perfectly fine uptil here..

Now,the law says another thing which is unless and until an individual has been proven guilty,he is innocent in the eyes of the law,no matter how much he has been condemned in the public or media..he is always alleged in a crime..this is the fundamental concept of judicial system all over the world...

Now comes the quesn of ethics..
1)If Jethmalani knows that Manu sharma is guilty and even then he helps him by taking bribe then as a citizen of India and as a human,he is in the wrong...the former for helping a criminal to get an escape and the latter,to get equally involved in a crime of taking a person's life..but this thing is tacitly understood by each one of us,it cnt be documented for the blind judicial system("andha kanoon")

2)Lets delve a bit into the legal terms of the case..Jethmalani went uptil the "character assasination" of the deceased,which even the Supreme Court condemned...He used character assasination of a dead individual to save his client..He had said that Jessica was a morally indecent,unscrupulous and character-less girl..This kind of an allegation on the deceased is condemned by the law itself..

3)I believe it is a quesn of indiviudal's values and morals which differs frm person to person..If I would be a lawyer,I wont take a case for which I have to have sleepless nights and inner guilt of saving a criminal whom I know committed a scandalous act..I would rather risk my life for a poor person who's child was sexually molested and harrassed by the some devils who had all the contacts and power to get scotfree..but thts for me to decide,which case to fight for??it is a quesn of my own value system and integrity..

4)there is no law above the law of humanity..one shall not forget that we all are nthing but mere creatures created by the Supreme being who has the entire bio-data of even minute karmas of ours..and for HIM,justice is "As you sow,so shall you reap"..No constitution,no fundamental rights,no legal system..just one fundamental law.."as you sow,so shall you reap"..

Every person is entitled to his right to defense and to hire whichever attorney he chooses. Instead of looking at the negatives of Ram Jetmalani being his lawyer just hire a lawyer who can give him some competition . With the high profile nature of this case i doubt any aspect will remain a secret leading to justice.
