guys, the question now becomes is not whether it is allowed or not - it is whether if u are in that judge's seat and u urself arent sure abt wat is going on is true or not - how can ne1 sentence a person to death or ne other sort of capital punishment if he/she aint sure abt the truth.
Judicial system in India is very slow - but systems jusdges can never be themselves sure as to wat is happening is true or not - the legal system newhere needs a person to leave his emotions behind - which ONLY A MACHINE WITH THE LAW PROGRAMMED INTO IT CAN DO - NOT A HUMAN BEING.

Nitin, what you are saying would make complete sense if the Judge doesnt know if the other person is a criminal. But what in cases like Rape cases, Murder, Mass kiling , Bomb explosions made by known people like of the Hizbul Mujahidin gang.

When the Judge is sure about it, isnt it justifiable that the person who commited the crime should be given the most tortured punishment ever so that others refrain from such acts ?
 
well in such cases there is no part of politics coming in - is it karthik - then the question is if a politician is involved - how far is he willing to go to save his butt. In case of known culprits the politics has to bend down and step away for public opinion which for the matters of bombings and proved murders are always going to be unanimus and without doubt - undeniable - which in present system our lawyers are good at hiding.
 
hmm.. nitin.. i see a contradiction in your opinion, If the politicians bend down and step away for public opinion, then we assume that the person is that damn guilty, which doesnt make any easier for the lawyer to defend. Incase, he is defended, we cant do much.. The question still remains , If found guilty, should there be Capital punishment ? Like in Emirates, An eye for an eye, a hand for a hand, a life for a life ;)
 
i totally agree wid venga,it is true tat in India the judiciary is not strict. it mends its rules accroding to the status of the criminal.as in case of salman khan he actually drove over a beggars and killed one and the punishment was declared aftr almost 2-3 yrs. the capital punishment should be made a complete YES in a nation where crimes are increasing in an alarming rate. like in India it is still used for crimes whch are too severe or the rarest of the rare.i hv actually read many cases on this context as we had a project on this topic and i had collected even the rate of usage of capital punishments all over the world.its surprising too see that the of late capital punishment given for raping a minor was a capital pinishment given in India after a gap of almost 12 years.so not surprisingly crimes are rising bcoz ppl think dnt fear wht the judiciary and the punishments
i wud say tat to keep a control of crimes imposing sever and strict punishment is a must.
 
c there r two sides of coin.i think capital punishment is totally justified but b/f that we need to ensure that r judiciary system is not biased.what if an innocent is hanged?just bcause something wrong happned to an innocent we cant kill another innocent na.So first find nd root out evil in our judicial nd political system
ND MIND ITS NOT THAT NOTHING CAN HAPPEN OF INDIA.INDIA IS NOT BAD ITS WE INDIANS WHO R CORRUPT.I SINCERLY HOPE THAT OUR GENERATION WILL B HAVING PRINCIPALS IN LIFE.WE HAV TO WORK UP TO MAKE OURSELF PRUOD OF OUR NATION
 
I would say yes
otherwise there is no fear and the criminal will get away easily after some yrs,with his sentence shortened(by gandhi jeyanthi stuff like that)
 
Agreed capital punishment is seriously required one has to over come the crime
and this is a good way atleast for a few yrs
and apart from this we need more of it we have to have our law strict very strict starting from the traffic police one needs to come up with some stratergic
and catch all the curropt ppl and give them seriously benchmark punishment
 
capital punishment is justified...n shud be implemented in India...but b4 that corruption syd be zero so innocent ppl are not framed..........
