The Transplantation of Human Organ Act plans to counter illegal trade of organs
that was passed in 1994, according to it, there can be no TRADING OF ORGANS.

Organs like the kidney cannot be sold for money, Kidney transplants are allowed legally only if the donor is parent / child / spouse / sibling for organ transplant.

Black marketing of organs is only existent because there is a shortage of organs for transplantation. To avoid this the country should have policies that encourage the trend of citizens becoming donors.

* Opting-in : Donors opt in to donate their organs and get a donors card made for themselves. The family members are not allowed to interfere if the donor has made a commitment during his lifetime to donate.

* Opting-out : All the civilians are potential donors and the family members dont have a say in the decision making if the person has NOT opted-out of the donation commitment.

So, I believe opting-out system is better than opting-in to keep the demand in check, also various other innovative policies like tax rebate on donation of blood could be taken on a pilot run.
