Samsung after being found to have infringed with 6 patents was slapped with a whooping $1.05 bn in charges:SugarwareZ-154: which is still less than $2.5 bn expected by Apple. Markets reacted by boosting Apple's stocks to an all time high of $675. I have no problem with the lawsuit that Apple bought forward for rounded square icons and what not. They are simply playing by patent rules. Where i have a problem :kelw:is the laws.
Its farcial in my opinion that patents are given to companies that claim to have invented a new shape which actually suppress creativity, in the end its the consumer who gets hurt by having to choose from a smaller array of products with a higher price tag.
Another disturbing component of this whole scenario is the fact that this monumental decision was made by a jury of nine average americans, one of whom was an unemployed videogame lover. The Jury had to endure a three week trial where hundreds of jargons were brought forward containing technical and legal vocab. They had to go through 28 samsung devices before giving a decision.
I seriously find the whole process incompetent to give such a big ruling.. what say???

Besides the distinctive advantages that each company has, dont you think the rules and regulations that are in place to regulate business are having an increasingly crippling effect on companies sometimes leaving aside the good ones ofcourse like the environmental regulations..:)
 
rightly pointed our prtk that jury should knowledgeable to make decision but as matter of fact Jury is the group of individual chosen form the general population to make decision. So there was nothing wrong in choosing average Americans for the jury member.

Now as far as companies are concerned they have to utilize their brand name and that why they are earning so there is nothing wrong if a company quoted higher price for the product. its all depend on customer choice that he/she wants to buy those product or not.

Companies are made to make profit not for selling there product at low margin. Till consumer is ready to pay price for the product its all fare.
 
I respect your opinions siddharth..but i fear i have to disagree..
I would like to point out here that we are not discussing about any criminal or average civilian case here..but a corporate one. If it would have been the former then the only thing required out of the Jury is a bit of common sense and a sense of integrity and that would suffice. But a trial where the jury has no idea about the management and technical jargon used through out the case is simply insane. The jury had no knowledge about the technicalities of the 28 models of Samsung that were presented to them..under such circumstances how can 1 expect the Jury to be competent enough to come out up with the right decision??

Coming to your opinion on companies and their price game.. the very basis of capitalism is competition and providing the consumer with more options..better goods and services at more competitive prices. That is one of the main fundas behind liberalization and globalization. Putting patents on basic shapes like circle, oval and square is ridiculous and creates kind of a monopolistic business scenario.

There are no issues with Apple quoting higher prices for its products..its only normal as its products fall into the premium and luxury segment. But i see no point bogging down Samsung with patent claims like this one, which seeks to provide good quality products at competitive prices than that of Apple.

No doubt patents help a lot when it comes to protection of IPR..but a patent on a basic shape like oval, square and all is simply outrageous..
 
You r right prtk but the case was filled in civil court and for some civil cases such as defamation and assault cases. jury is needed. As far as jury member are concern there selection is done by attorneys. They use different method and expert advice to select any jury member. :spy:

Apple had a history of filling crazy patents so there was nothing new in this case. Some of the patent are Glass staircase, In-store iPad stand, packaging and many more.

As argument given by Samsung in court “We continue to believe that Apple was not the first to design a tablet with a rectangular shape and rounded corners and that the origins of Apple's registered design features can be found in numerous examples," was appropriate. So I think it’s just a marketing strategy to get attention. All this cases help companies to increase there sales. :SugarwareZ-058:
 
I prefer Samsung no matter if everyone states that Samsung copied Apple. I do not recognize Apple's insistence that anything you do while using iphone, ipad, ipod etc needs to be completed on their website. I don't want the entire of my life tale at Apple's convenience to work. They also charge fee for most services you can find for free with the Android techniques.
 
Between the two, I would support Samsung. You get more for your money with them, and I prefer the Android OS. Apple devices just have a cult following, and they are like fashion accessories rather than utilitarian devices that I need. I would likely go for a different company entirely though.
