Hurdles in RTE implementation

More than a month after the Right to Education (RTE) Act came into effect, the state government has started facing hurdles in its implementation.

The recruitment of around 3 lakh additional teachers, as per the mentioned pupil-teacher ratio in the RTE Act, is proving to be one of the major hurdles. The authorities claim that some of the clauses in the Act are contradictory.

“The Centre has to come out with clear guidelines and clarify whether teachers should be recruited within six months or 3 years,” said Ashok Ganguly, Additional State Project Director, Sarva Shiksha Abhiyan (SSA).

According to him, clause 25 of the Act states that the required number of teachers as per the pupil-teacher ratio should be recruited within a time frame of six months while clause 19 mentions three years as the time limit. “This confusion needs to be removed by the Centre,” said Ganguly. “If additional teachers have to be recruited within six months, then a month has already passed. It will be difficult to recruit so many teachers in such a short period,” he said.

Currently, there are around 3 lakh teachers in primary and upper primary schools of the state for 1.71 crore students studying in 1.5 lakh primary schools and 30 lakh students studying in 45,000 upper primary schools.

Other than this, issues related to funding are also acting as a hurdle in the implementation of the Act. “There are certain provisions like construction of new schools that we will undertake, but it will not match up to the requirements of RTE,” he said.

“We have been allocated Rs 450 crore for activities of SSA like construction of additional schools, classrooms and toilets. However, our requirement for implementation as per RTE is Rs 12,000 crore per year in terms of recurring expenditure, besides a non-recurring expenditure of Rs 4,000 crore. There has to be a separate fund for the RTE,” said Ganguly.

“A structured consultative process on the RTE implementation is yet to take place. The state government has raised these issues with the Centre for which we have received assurances as well. But concrete steps are yet to be taken,” said Ganguly.

What the clauses read

* Clause 25: Within six months of the date of commencement of this Act, the appropriate government and the local authority shall ensure that the pupil-teacher ratio, as specified in the schedule is maintained in each school.

* Clause 19: Where a school established before the commencement of this Act does not fulfill the norms and standards specified in the schedule, it shall take steps to fulfill such norms and standards at its own expenses, within a period of three years from the date of such commencement
