BMW case: Delhi HC issues notices to lawyers
Tuesday, August 7, 2007 (New Delhi)
Observing that there was prima facie an attempt to interfere with the judicial proceedings in the BMW hit-and-run case, the Delhi High Court on Tuesday issued show cause notices to defence counsel R K Anand and Public prosecutor I U Khan for their alleged collusion to influence prime witness Sunil Laxman Kulkarni.

''The meetings and conversations of the Public Prosecutor (Khan) as well as Defence Counsel (Anand) with Kulkarni, prima facie demonstrate interference in the due course of judicial proceedings and with the administration of justice, constituting criminal contempt,'' the Bench of Justice Manmohan Sarin and Justice S K Mishra remarked.

''We are prima facie satisfied that you R K Anand, I U Khan have willfully and deliberately tried to interfere with due course of judicial proceedings and administration of justice by the courts,'' observed the Bench in a 10 page order.

The court also issued notices to Anand's associate advocate Bhagwan Sharma and alleged middleman Lovely and asked all of them to file their replies within four weeks.

For the past few months the Delhi HC has been investigating a sting conducted by NDTV, which showed defence and prosecution colluding to influence the key witness Sunil Kulkarni in the BMW case.
